By using the TradingView website, mobile applications, and any associated services (collectively, the “Service”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, you should not access or use the Service.

IMPORTANT NOTICE: These Terms contain a binding arbitration agreement and class action waiver. By agreeing to these Terms, you agree to resolve disputes through binding individual arbitration and waive your right to participate in class actions. You may opt out of the arbitration agreement within 30 days of first accepting these Terms.

1. Changes to the Terms of Use

TradingView, Inc. (“TradingView,” “we,” “us,” or “our”) reserves the right to modify these Terms at any time at its sole discretion. When changes are made, we will update the “Last updated” date at the top of this page. Your continued use of the Service after the posting of revised Terms constitutes your acceptance of such changes. We encourage you to review these Terms periodically.

2. Changes to TradingView

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service or any part thereof.

3. Ownership of Information; License to Use TradingView; Redistribution of Data

Unless otherwise indicated, the Service and all content and other materials on the Service, including, without limitation, the TradingView logo, and all designs, text, graphics, pictures, data, software, sound files, other files, and the selection and arrangement thereof (collectively, “Content”) are the proprietary property of TradingView or its licensors or users and are protected by applicable intellectual property laws.

You are granted a limited, non-sublicensable license to access and use the Service and its Content solely for your personal, non-commercial use. This license is subject to these Terms and does not include:

Any resale or commercial use of the Service or its Content;
The distribution, public performance, or public display of any Content;
Modifying or otherwise making any derivative uses of the Service or its Content;
Use of any data mining, robots, or similar data gathering or extraction methods;
Downloading (other than page caching) of any portion of the Service or its Content;
Any use of the Service or its Content other than for its intended purpose.

Non-Display Usage

“Non-display usage” refers to any use of market data obtained through the Service for purposes other than display, including but not limited to: automated trading, algorithmic decision-making, order routing, portfolio management, risk management, or any use by third-party tools or applications that facilitate such activities. Non-display usage of data obtained through the Service is strictly prohibited unless expressly authorized in writing by TradingView.

4. Attribution

You may share chart snapshots generated by TradingView, provided that you include proper attribution to TradingView. Attribution must include a visible reference to “TradingView” in a legible font (minimum 10pt). Removal or obscuring of the TradingView watermark or attribution from any chart snapshot is prohibited.

5. Third-Party Sites and Advertisers

The Service may contain links to third-party websites, advertisers, services, special offers, or other events or activities that are not owned or controlled by TradingView. We do not endorse or assume any responsibility for any such third-party sites, information, materials, products, or services. If you access a third-party website or service from the Service, you do so at your own risk, and you understand that these Terms do not apply to your use of such sites.

6. User Accounts

To access certain features of the Service, you must register for an account. When you register for an account, you agree to provide accurate, current, and complete information and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account.

You agree not to:

Create more than one account per person;
Share your account credentials with any third party;
Use another user’s account without permission;
Sell, trade, or transfer your account to another party.

7. User Content

The Service allows you to post, link, store, share, and otherwise make available certain information, text, graphics, or other material (“User Content”). You are responsible for the User Content that you post, including its legality, reliability, and appropriateness. By posting User Content on or through the Service, you grant us the right to use, modify, publicly perform, publicly display, reproduce, and distribute such User Content on and through the Service.

8. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

Using the Service for any illegal purpose or in violation of any applicable law;
Harassing, threatening, intimidating, or impersonating other users;
Posting false, misleading, or fraudulent content;
Attempting to gain unauthorized access to the Service, other accounts, or computer systems;
Interfering with or disrupting the Service or servers or networks connected to the Service;
Using the Service to send spam, chain letters, or unsolicited messages;
Scraping, data mining, or using automated means to collect data from the Service;
Circumventing any measures designed to prevent or restrict access to the Service.

9. Intellectual Property Rights

TradingView respects the intellectual property rights of others and expects its users to do the same. We will respond to notices of alleged copyright infringement that comply with applicable law and are properly provided to us. If you believe that your content has been used in a way that constitutes copyright infringement, please provide us with written notice containing the information required under the Digital Millennium Copyright Act (DMCA).

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TRADINGVIEW EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

TRADINGVIEW DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED. TRADINGVIEW MAKES NO WARRANTY REGARDING THE QUALITY, ACCURACY, TIMELINESS, TRUTHFULNESS, COMPLETENESS, OR RELIABILITY OF ANY CONTENT AVAILABLE THROUGH THE SERVICE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TRADINGVIEW, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

12. Indemnification

You agree to defend, indemnify, and hold harmless TradingView, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Service.

13. Arbitration Agreement

Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration. The arbitration shall be administered in accordance with the rules of the applicable arbitration association. Judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
